Cancellation Policy

Private Tours Berlin offers a full refund on cancellations made 7 days or more prior to your tour taking place. 75% of the tour price will be refunded for cancellations within 7 days, as well as any potential costs associated with the cancellation of vehicles, entry tickets etc. Cancellations within 48 hours of your tour start time are charged 50% of the tour price, as well as any potential costs associated with the cancellation of vehicles, entry tickets etc. No-shows and cancellations on tour day are charged full price.  

It is highly recommended that you carry a mobile device with you to the designated meeting point. Please provide us with the phone number and email address of that device upon booking. If you are late or lost, we will do our best to contact you. If we successfully contact you and you are still unable to attend your tour as scheduled, we are unable to grant a refund.

Cancellation due to transport disruptions

As stated above, we do not refund clients who do not show up on time for tours. This includes, but is not limited to, tardiness due to flight or train cancellations, delays or issues caused by traffic or congestion. In general, we do not refund any private tour cancelling on tour day.

To protect you from this portion of our cancelation policy, we recommend the purchase of travel insurance. Be sure to ask a representative if the insurance policy covers losses due to delays and cancellations. We also recommend getting that in writing. Private Tours Berlin does not take responsibility if a policy does not cover any losses due to delays. Each traveler should be diligent when selecting a policy to ensure it covers trip disruptions.

In the case of a delay, we recommend contacting us as soon as you know you will be late. The earlier we know, the more we can do for you.

Travel Insurance

On purchasing tours and services from Private Tours Berlin the client enters into an agreement whereby both Private Tours Berlin and any of their suppliers are not liable for any unforeseen or extenuating circumstances. Private Tours Berlin does not provide travel insurance and strongly advises that clients purchase private travel insurance in their country. Our guest's travel insurance should cover any cancellation or delays owing to extenuating and unforeseen circumstances. Such circumstances include, but are not limited to, travel delays or cancellations, natural calamities and weather conditions, terrorism, war or strike action. Our guests are also strongly recommended to purchase medical insurance to cover any medical expenses and ensuing cancellation of services and personal insurance to cover loss or damage of personal belongings.

Exclusion of Liability

Private Tours Berlin, under no circumstances, will be liable for any losses or damage, (whether foreseeable, known, unforeseeable, and otherwise), due to: (a) sickness; (b) strikes; (c) pilferage; (d) labour disputes; (e) machinery breakdown; (f) government restraints; (g) hostilities; (h) acts of war; (i) terrorism; (j) weather conditions; (k) acts of nature; (l) seismic events; (m) clauses in local laws. Clients accept that Private Tours Berlin, its respective directors, employees, agents and suppliers shall not be liable for any loss or damage, including but not limited to, any loss or damage to the client’s or other person’s property, or the client’s or other person’s state of health, injury or death, which the client or any other person may suffer or incur during the client’s participation of the tour. Furthermore, the client holds Private Tours Berlin and its respective directors, employees, agents and suppliers harmless from and against any loss, damage, proceedings, demands, claims and other legal costs, fees and expenses resulting from incidents which occur during the client’s participation in the tour.

Participation

Participation in a Private Tours Berlin tour is strictly voluntary and both your freelance guide and Private Tours Berlin are able to deny participation to anybody for any reason at any time.

As in all human undertakings, there is a degree of risk. We endeavour to ensure a minimum level of risk. Private Tours Berlin and its contractors assume no liability or responsibility for any injury, loss, damage or inconvenience sustained by any person, or items belonging to a person using its services.

Copyright

All content on Private Tours Berlin is owned and protected by our Copyright agreement. In order to modify, reproduce, copy, publicize, diffuse or download any of our content you must obtain prior written consent from Private Tours Berlin. Private Tours Berlin will aim to notify its clients of any unexpected closures of monuments/sites included in the tour itinerary. However decisions to close monuments are made by the administration of the site and Private Tours Berlin accepts no responsibility in the case that a client is unable to visit a site included in their tour itinerary for unforeseen circumstances or circumstances beyond our control.

Legal Limitations of Responsibility

Private Tours Berlin will endeavour to resolve issues and disputes as based on our Cancellation and Amendment Policy in an equitable and efficient manner. In all events, Private Tours Berlin cannot be held liable or responsible for any legal, medical or other costs that may be incurred, whether or not these are due to the timeliness or delay of Private Tours Berlin.

Legal Jurisdiction

Private Tours Berlin will endeavour to resolve all issues based on the terms of this Cancellation and Amendment Policy. In the event that an issue cannot be resolved to the satisfaction of both parties, legal jurisdiction will be Germany.

Dispute

When using your credit card, these details will remain classified and only you and your credit card provider will have access. In case of dispute, if you have made a booking and you do not show up to the tour or you cancel the tour within the penalty periods indicated in our cancelation policy, no refund and authorization of chargeback will be provided from our company. We remind you that when you purchase a tour you accept our terms and conditions.
